Supplemental InformationOffice of the Secretary – Legal Division The Office of the Secretary serves as the department's executive management office. The Secretary is the chief officer of the Department of Energy and Natural Resources (DENR), in charge of its policy, administration, and operations.The Legal Division provides various legal services to all areas within DENR. They review contracts and other documents which could have liability implications for DENR or the state. Additionally, the Legal Division coordinates public records requests for the Department.Employees are eligible for flexible work schedules upon hire and up to two (2) days of telework after six (6) months.LOCATION AND POSITION INFORMATION:This Attorney 1-3 is located in the Office of the Secretary and reports to the unclassified Executive Counsel. This position serves as a senior legal advisor to DENR executive leadership on matters involving energy development regulation and enforcement with a focus on renewable energy and implementation and representation of the department in solar generation facility permitting, regulation and enforcement.Additional duties and responsibilities include, but are not limited to the following:
Advise Leadership on Renewable Energy Development Regulation and Enforcement
Analyzes and provides guidance to DENR leadership and leadership of DENR’s various offices on matters involving regulation and enforcement of renewable energy development both on state-owned and private property, with a focus on solar and wind power development regulation.
Assists the department with the drafting and promulgation of necessary rules, guidelines, and standard operating procedures.
Represent the Department on Renewable Energy Development Regulation and Enforcement
Represents DENR, its offices and officers in litigation and administrative proceedings concerning other legal matters under the department’s jurisdiction, including before federal and state courts, before other administrative agencies, boards, and commissions, and in front of local governments.
Ensures that case, permit, enforcement, and legal matter files are created and maintained in accordance with department file systems and that pertinent information is shared to meet legal, judicial, and procedural requirements of the department.
Assists DENR leadership as directed with reviewing, analyzing and advising on proposed legislation pertinent to the department’s mission and responsibilities, including communicating with the executive administration, other agencies, legislators, and legislative staff, and testifying before legislative committees on behalf of the department.
Performs all other duties as assigned.
