Applicants must be eligible to work in the United States at the start of employment.Direct Care and Treatment (DCT) is seeking an individual to join our DCT General Counsel’s Office for an exciting and rewarding opportunity as a Data Privacy Attorney! This position will provide legal expertise and advice to DCT, as well as compliance support across all DCT administrations on a variety of diverse, complex, and changing areas of law and policy affecting DCT, with a focus on data privacy and data security issues. The Data Privacy Attorney will provide DCT senior leaders, including executive leadership, and staff with legal expertise and compliance support to ensure DCT’s compliance with all state and federal data privacy and security laws and policies. This position will serve as a lead in conducting legal and policy research and analysis and providing advisement on diverse and complex matters, including, but not limited to state and federal laws and policies governing data privacy and security matters as they relate to the DCT in its policymaking and the provision of programs, services, and health care, legislative efforts, contracts and data sharing agreements, employment matters, investigations and audits, involvement in litigation, privacy and security trainings, and compliance with policies and controlling legal authority.Primary Responsibilities:

Lead and support DCT’s compliance with diverse, complex, and changing laws in the areas of data privacy, data security, and related policies and laws by conducting legal and policy research.

Support the fulfillment of requests for public data and the tracking and compliance requirements associated with them.

Serve as a legal expert and in a lead legal advisor role to provide legal advice to DCT senior leaders, including executive leadership, and program area managers across the agency on data privacy, data security, and related legal issues including diverse and complex matters, involving DCT.

Monitor and manage data privacy and security issues involving DCT and use legal expertise to advise, coordinate, and manage information and activities in support of favorable outcomes for DCT.

Using knowledge of substantive law and policy, serve in a lead role in conducting legislative analysis, legislation drafting, and related writing to support DCT legislative objectives.

Minimum QualificationsJD degree from an ABA accredited law school;Current license and in good standing to practice law in Minnesota;Three (3) years as a practicing attorney in the areas of data privacy and security. Experience must demonstrate the following:

Experience with state and federal data privacy laws as they relate to human services programs.

Experience with Minnesota Government Data Practices Act, Health Insurance Portability and Accountability Act, and Health Information Technology for Economic and Clinical Health Act.

Experience providing legal advice to executive level leadership on complex legal issues.

Preferred Qualifications

Public Sector privacy and security experience.

Litigation experience.
